1. הצדדים והתפקידים
הסכם זה נערך בין המועדון (בעל השליטה במאגר) לבין KesemItay, שמפעילה את RAKIA (המחזיקה והמעבדת). הוא חלק מתנאי השימוש וחל מההעלאה הראשונה של המועדון.
2. איזה מידע מעובד
שמות ספורטאים, תוצאות, תאריכי לידה, מגדר, הערות, תמונות והשוואות של מאפייני פנים (מידע ביומטרי, שמחושב בזיכרון ואינו נשמר), פוסטרים וכיתובים; שמות וכתובות הדוא"ל של משתמשי המועדון. האנשים שהמידע עוסק בהם: ספורטאים (כולל קטינים), מאמנים וצוות המועדון.
3. מטרה והוראות
אנו מעבדים את המידע רק כדי לזהות תוצאות, להתאים תמונות, להפיק, לשמור ולפרסם את הפוסטרים והכיתובים של המועדון ולהפעיל את עוזר הטלגרם שלו, לפי הוראות המועדון המתועדות (תנאים אלה, ההגדרות שלו והאישורים שלו). איננו משתמשים בו עבור מועדונים אחרים, לשיווק של RAKIA או לאימון מודלים של בינה מלאכותית בלי הסכמה בכתב של המועדון.
4. סודיות
כל מי ב-RAKIA שיש לו גישה למידע מחויב בסודיות.
5. אבטחה
תקשורת מוצפנת (HTTPS), גישה לפי תפקיד, מסד נתונים סגור לגישה ציבורית, הפרדה בין מועדונים בכל קריאה וכתיבה, תמונות שנשמרות בדרייב של המועדון עצמו, וגיבויים של מסד הנתונים שנשמרים עד 5 שבועות.
6. ספקי משנה
Supabase (האיחוד האירופי), Vercel, Fly.io (הולנד), Google (דרייב, Gemini, כניסה), OpenAI, Anthropic, Telegram, Meta (רק אם המועדון מחבר אינסטגרם), Resend ו-Microsoft Clarity (בדפים הציבוריים, בהסכמה). נודיע 30 יום מראש לפני הוספת ספק משנה; המועדון רשאי להתנגד ולסיים את השירות. כל ספק משנה מחויב בתנאי הגנת מידע שאינם חלשים מאלה.
7. העברות
RAKIA מופעלת מישראל (החלטת הלימות של האיחוד האירופי). ספקים בארה"ב מקבלים מידע לפי מסגרת פרטיות המידע בין האיחוד האירופי לארה"ב כשהם רשומים בה, ואחרת לפי הסעיפים החוזיים התקניים של הנציבות האירופית.
8. סיוע
נעזור למועדון לענות לבקשות של ספורטאים, הורים וצוות, וגם באבטחה, בדיווח על אירועי אבטחה ובהערכות השפעה.
9. אירועי אבטחה
נודיע למועדון בלי דיחוי אחרי שנדע על אירוע שפוגע במידע שלו, עם העובדות שהוא צריך לדיווחים שלו.
10. סיום השירות
תוך 90 יום מסיום ההתקשרות נמחק את נתוני המועדון, או ניתן לו קודם עותק של הפוסטרים שלו אם יבקש, ונאשר זאת בכתב. עותקי גיבוי נמחקים תוך 5 שבועות לאחר מכן.
11. ביקורת
ניתן למועדון את המידע שהוא צריך כדי להראות עמידה בהסכם, ונענה לשאלות ביקורת סבירות פעם בשנה.
Data Processing Agreement

1. Parties and roles
This agreement is between the club (controller) and KesemItay, which operates RAKIA (processor). It forms part of the Terms of Use and applies from the club's first upload.
2. What we process
Athletes' names, results, birth dates, gender, notes, photos and facial-feature comparisons (biometric data, computed in memory and not stored), posters and captions; the names and emails of the club's users. People concerned: athletes (including minors), coaches and club staff.
3. Purpose and instructions
We process this data only to detect results, match photos, produce, store and publish the club's posters and captions, and run the club's Telegram assistant, on the club's documented instructions (these terms, the club's settings and its approvals). We do not use it for other clubs, for RAKIA's marketing or to train AI models without the club's written consent.
4. Confidentiality
Everyone at RAKIA with access to the data is bound by confidentiality.
5. Security
Encrypted traffic (HTTPS), access limited by role, a database closed to public access, separation between clubs in every read and write, photos kept in the club's own Drive, and database backups kept for up to 5 weeks.
6. Sub-processors
Supabase (EU), Vercel, Fly.io (Netherlands), Google (Drive, Gemini, sign-in), OpenAI, Anthropic, Telegram, Meta (only if the club connects Instagram), Resend and Microsoft Clarity (public pages, with consent). We give 30 days' notice before adding a sub-processor; the club may object and end the service. We bind each sub-processor to data-protection terms no weaker than these.
7. Transfers
RAKIA is run from Israel (EU adequacy decision). US providers receive data under the EU-US Data Privacy Framework where certified, otherwise under the European Commission's Standard Contractual Clauses.
8. Help
We help the club answer requests from athletes, parents and staff, and with its security, breach notices and impact assessments.
9. Breaches
We tell the club without undue delay after we learn of a breach affecting its data, with the facts it needs for its own notifications.
10. End of service
Within 90 days after the relationship ends we delete the club's data, or first give the club a copy of its posters if it asks, and confirm this in writing. Backup copies roll off within 5 weeks after that.
11. Audit
We give the club the information it needs to show compliance and answer reasonable audit questions once a year.
