מי מפעיל את השירות

RAKIA (רקיע) מבית KesemItay. השירות מופעל על ידי איתי מזרחי, עוסק פטור הרשום בישראל. ליצירת קשר: kesemitaymedia@gmail.com. השימוש באתר ובמערכת מהווה הסכמה לתנאים אלה ולמדיניות הפרטיות.

מה השירות

RAKIA מזהה הישגים של ספורטאי המועדון מתוך תוצאות תחרויות שפורסמו, מפיקה פוסטרים ותוכן לרשתות החברתיות בעיצוב המועדון, ומאפשרת למועדון לאשר ולפרסם. הפרסום נעשה רק אחרי אישור של נציג המועדון.

חשבון מועדון

  • חשבון נפתח למועדון על ידי RAKIA. המועדון אחראי למי שהוא מזמין למערכת ולשמירה על פרטי הכניסה.
  • המועדון מתחייב למסור מידע נכון ולעדכן אותו.

תמונות, זכויות והסכמות: אחריות המועדון

  • המועדון מצהיר שיש לו זכות להשתמש בכל תמונה, לוגו וחומר שהוא מעלה או מחבר למערכת, כולל קרדיט לצלם כנדרש.
  • המועדון אחראי לקבל הסכמה של הספורטאים, ושל הורים לקטינים, לפני פרסום. המערכת מספקת מנגנון הסכמה לכל ספורטאי.
  • RAKIA רשאית להציג פוסטרים שהופקו כדוגמאות לעבודתה, אלא אם המועדון ביקש בכתב שלא.

קניין רוחני

הפוסטרים שהופקו למועדון שייכים למועדון לשימושו החופשי. המערכת, המנוע, העיצובים הגנריים והמותג RAKIA שייכים ל-KesemItay. אין להעתיק את המערכת, לבצע בה הנדסה לאחור, או למכור אותה הלאה.

שימוש הוגן

אין להשתמש במערכת להפקת תוכן פוגעני, מטעה, או כזה שמפר זכויות של אחרים. RAKIA רשאית להשעות חשבון שמפר תנאים אלה לאחר התראה.

תשלום

תנאי התשלום, המחיר ותקופת ההתקשרות נקבעים בהסכם נפרד בכתב עם כל מועדון. עד לחתימת הסכם, השירות ניתן כפיילוט.

זמינות ואחריות

אנחנו עושים מאמץ שהמערכת תפעל ברציפות, אך היא נשענת על שירותים חיצוניים (אתרי תוצאות, רשתות חברתיות, ספקי ענן) ואיננו מתחייבים לזמינות מלאה. השירות ניתן כמות שהוא. אחריות RAKIA כלפי המועדון מוגבלת לסכום ששולם ב-12 החודשים שקדמו לאירוע. אין באמור כדי לגרוע מזכויות שאינן ניתנות להתניה לפי דין.

סיום

כל צד רשאי לסיים את ההתקשרות בהודעה בכתב של 30 יום. עם הסיום, המועדון יכול לבקש עותק של הפוסטרים שלו, ונתוני המועדון יימחקו כמפורט במדיניות הפרטיות.

דין וסמכות שיפוט

על תנאים אלה חל הדין הישראלי. סמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים במחוז תל אביב.

שינויים

נעדכן עמוד זה כשמשהו משתנה, עם תאריך העדכון למעלה. שינוי מהותי יישלח ללקוחות במייל.

Who runs the service

RAKIA by KesemItay. The service is operated by Itay Mizrachi, a registered sole proprietor (Osek Patur) in Israel. Contact: kesemitaymedia@gmail.com. Using the site or the system means you accept these terms and the privacy policy.

What the service is

RAKIA detects club athletes' achievements from published competition results, produces posters and social-media content in the club's design, and lets the club approve and publish. Nothing is published without a club representative's approval.

Club account

  • RAKIA opens an account for the club. The club is responsible for whom it invites and for keeping sign-in details safe.
  • The club agrees to provide accurate information and keep it current.

Photos, rights and consent: the club's responsibility

  • The club confirms it has the right to use every photo, logo and asset it uploads or connects, including photographer credit where required.
  • The club is responsible for obtaining consent from athletes, and from parents of minors, before publication. The system provides a per-athlete consent switch.
  • RAKIA may show produced posters as examples of its work unless the club asks otherwise in writing.

Intellectual property

Posters produced for the club belong to the club, to use freely. The system, the engine, the generic designs and the RAKIA brand belong to KesemItay. Do not copy, reverse-engineer or resell the system.

Fair use

Do not use the system to produce content that is offensive, misleading or infringes others' rights. RAKIA may suspend an account that breaks these terms, after notice.

Payment

Price, payment terms and contract period are set in a separate written agreement with each club. Until an agreement is signed, the service is provided as a pilot.

Availability and liability

We work to keep the system running continuously, but it depends on external services (results websites, social networks, cloud providers) and we do not guarantee full availability. The service is provided as is. RAKIA's liability to the club is limited to the amount paid in the 12 months before the event. Nothing here limits rights that cannot be waived by law.

Termination

Either side may end the relationship with 30 days' written notice. On termination the club may request a copy of its posters, and club data is deleted as described in the privacy policy.

Governing law

These terms are governed by the laws of Israel. The competent courts of the Tel Aviv district have exclusive jurisdiction.

Changes

We update this page when something changes, with the date at the top. Material changes are emailed to customers.
