מי מפעיל את השירות

RAKIA (רקיע) מבית KesemItay. השירות מופעל על ידי איתי מזרחי, עוסק פטור הרשום בישראל. כתובת: שיבת ציון 11, ראשון לציון. ליצירת קשר: kesemitaymedia@gmail.com. ההתקשרות עם מועדון נוצרת כשנציג המועדון נרשם ומאשר תנאים אלה, או בחתימה על הסכם. תנאים אלה חלים יחד עם מדיניות הפרטיות והסכם עיבוד המידע.

מה השירות

RAKIA מזהה הישגים של ספורטאי המועדון מתוך תוצאות תחרויות שפורסמו, מפיקה פוסטרים ותוכן לרשתות החברתיות בעיצוב המועדון, ומאפשרת למועדון לאשר ולפרסם. הפרסום נעשה רק אחרי אישור של נציג המועדון.

בינה מלאכותית

הפוסטרים והכיתובים מופקים בעזרת מודלים של בינה מלאכותית של צדדים שלישיים (המפורטים במדיניות הפרטיות), על בסיס תמונות אמיתיות שהמועדון מספק. המערכת עשויה לשנות רקע, תאורה ובגדים (למשל הלבשה בתלבושת המועדון). היא בנויה לשמור על הפנים האמיתיות של הספורטאי ובודקת אותן, אך התוצר עלול לכלול טעויות. לכן המועדון בודק כל פוסטר לפני האישור, והוא האחראי לפרסום של מה שאישר. אסור להשתמש במערכת כדי ליצור תמונה מטעה, משפילה או מינית של אדם אמיתי, או תוכן פוליטי או תעמולת בחירות. אדם שמופיע בפוסטר ורוצה להסירו יכול לכתוב אל kesemitaymedia@gmail.com. תוך 48 שעות נסיר את הפוסטר מהמערכת ונבקש מהמועדון להסיר עותקים שכבר פורסמו. רוקי, הצ'אט שעוזר ליצור ולשנות פוסטרים, הוא עוזר אוטומטי מבוסס בינה מלאכותית ולא אדם, והוא עלול לטעות; בדקו את התוכנית ואת הפוסטר לפני שאתם מאשרים, מורידים או מפרסמים. פוסטר שצויר בבינה מלאכותית עשוי לשאת בקובץ שלו סימון בלתי נראה שאומר שהוא נוצר בבינה מלאכותית (שום פיקסל לא משתנה). אם פוסטר מציג אדם אמיתי במקום או ברגע שלא קרו באמת, ייתכן שהחוק במקום שבו אתם מפרסמים (למשל חוק הבינה המלאכותית של האיחוד האירופי) מחייב לציין שהוא נוצר בבינה מלאכותית; באינסטגרם ובפייסבוק יש לשם כך תווית AI.

חשבון מועדון

  • השירות מיועד לארגונים (מועדונים, אגודות, איגודים וחברות) לשימוש בפעילותם, ומי שנרשם מצהיר שהוא פועל מטעם ארגון כזה. המועדון פותח חשבון בעצמו באתר, או ש-RAKIA פותחת אותו עבורו. המועדון אחראי למי שהוא מזמין למערכת ולשמירה על פרטי הכניסה.
  • המועדון מתחייב למסור מידע נכון ולעדכן אותו.

תמונות, זכויות והסכמות: אחריות המועדון

  • המועדון מצהיר שיש לו זכות להשתמש בכל תמונה, לוגו וחומר שהוא מעלה או מחבר למערכת, כולל קרדיט לצלם כנדרש. ההרשאה שבידי המועדון כוללת גם עיבוד ושינוי של התמונה לפוסטר, כולל בעזרת בינה מלאכותית. אם יתברר שלא כך, המועדון יישא בתביעות שיוגשו בשל כך.
  • המועדון אחראי לקבל הסכמה מדעת של הספורטאים, ושל הורה או אפוטרופוס לספורטאים מתחת לגיל 18, לפני שהוא מוסיף אותם או את תמונותיהם למערכת, כולל לזיהוי פנים, לעיבוד בבינה מלאכותית ולפרסום. בהוספת ספורטאי או תמונה, או בחיבור תיקיית תמונות, המועדון מאשר שיש בידו הסכמה זו.
  • הסכמה דרך המועדון. בהצטרפות למועדון שמשתמש ב-RAKIA, ספורטאי (או הורה או אפוטרופוס, לגבי ספורטאי מתחת לגיל 18) מסכים, דרך המועדון, שהתמונות שלו ישמשו ושהפנים שלו יותאמו כדי להפיק את הפוסטרים של המועדון. המועדון אחראי לקבל את ההסכמה הזו ולשמור אותה (הוא מאשר אותה בכל הוספת ספורטאי), ולהסביר זאת לספורטאים שלו. אין ב-RAKIA מתג נפרד לכל ספורטאי: ספורטאי שכבר לא רוצה בכך פונה למועדון, והמועדון מסיר את התמונות שלו (או מבקש מאיתנו לעשות זאת), ואז התמונות ותוצאות התאמת הפנים נמחקות.
  • RAKIA תציג פוסטר שהופק למועדון כדוגמה לעבודתה רק לאחר שהמועדון הסכים לכך בכתב, והספורטאים שמופיעים בו (או הורה או אפוטרופוס, לגבי מי שמתחת לגיל 18) הסכימו לשימוש זה של RAKIA. המועדון או הספורטאי רשאים לחזור בהם בכל עת, ו-RAKIA תסיר את הפוסטר מהאתר ומהחומרים שלה תוך 14 יום.
  • הגנת מידע. לגבי מידע אישי על ספורטאים, המועדון הוא בעל השליטה במידע ו-RAKIA מעבדת אותו מטעמו. הסכם עיבוד המידע שלנו בכתובת /dpa הוא חלק מתנאים אלה וחל מההעלאה הראשונה.

הדלת האישית (בטא)

בכתובת app.rakia.io/personal_beta אדם פרטי יכול להזמין פוסטרים לעצמו. הדלת האישית מיועדת לגיל 13 ומעלה; בגיל 13 עד 17 פוסטר נוצר רק אחרי שהורה אישר (ראו את מדיניות הפרטיות). זו גרסת בטא: היא חינמית, מוגבלת למספר ציורים לאדם (5 בהתחלה; פוסטר חדש, שינוי שמצייר את כל הפוסטר מחדש או סטורי עולים ציור אחד, תיקון קטן בתמונה עשוי לעלות חצי ציור, ושינויי טקסט ולוגו בקוד אינם נספרים), וניתנת כמו שהיא, בלי התחייבות לזמינות או לתוצאה. מי שמעלה תמונה מצהיר שיש לו זכות להשתמש בה ובתמונות האנשים שבה, ואם מופיע בה קטין, שההורה הסכים. הפוסטרים מיועדים לשימוש האישי שלכם. אין בבטא תשלום; אם נפתח תשלום בעתיד, המחיר ותנאי הביטול יוצגו לפני כל חיוב.

מה שאתם מעלים, הדוגמה והסרה

  • אתם אחראים למה שאתם מעלים. העלו רק תמונות, דוגמאות ולוגואים שהם שלכם או שיש לכם רשות להשתמש בהם, ותמונות של אנשים אחרים רק אם הם הסכימו.
  • פוסטר הדוגמה שאתם מוסיפים משמש רק לסגנון שלו: צבעים, פריסה ואווירה. RAKIA לעולם לא מעתיקה את האנשים, התמונות או המילים שבו.
  • הודעה והסרה. אם אתם חושבים שמשהו שנעשה ב-RAKIA מפר את הזכויות שלכם, כתבו אל kesemitaymedia@gmail.com (או מלאו את טופס הדיווח על הפרה), ואנחנו נבדוק ונסיר אותו תוך 48 שעות. אנחנו שומרים רישום של כל פנייה.
  • נקודת קשר (לפי חוק השירותים הדיגיטליים של האיחוד האירופי, לרשויות ולמשתמשים): kesemitaymedia@gmail.com, בעברית או באנגלית. כל פנייה נבדקת על ידי אדם מהצוות שלנו, לא רק על ידי מחשב.

קניין רוחני

RAKIA מעבירה למועדון את כל הזכויות שיש לה בפוסטרים שהופקו עבורו, ונותנת לו רישיון חופשי לשימוש בהם. אין בכך כדי לגבור על זכויות הספורטאים שמופיעים בהם או על זכויות הצלמים. המערכת, המנוע, העיצובים הגנריים והמותג RAKIA שייכים ל-KesemItay. אין להעתיק את המערכת, לבצע בה הנדסה לאחור, או למכור אותה הלאה.

שימוש הוגן

אין להשתמש במערכת להפקת תוכן פוגעני, מטעה, או כזה שמפר זכויות של אחרים. RAKIA רשאית להשעות חשבון שמפר תנאים אלה לאחר התראה בכתב ו-7 ימים לתיקון. תוכן בלתי חוקי או פוגע בקטין יוסר מיד, ונודיע על כך למועדון.

תשלום

תנאי התשלום, המחיר ותקופת ההתקשרות נקבעים בהסכם נפרד בכתב עם כל מועדון. עד לחתימת הסכם, השירות ניתן כפיילוט. פיילוט אינו הופך לשירות בתשלום באופן אוטומטי; שירות בתשלום מתחיל רק בהסכם חתום.

זמינות ואחריות

אנחנו עושים מאמץ שהמערכת תפעל ברציפות, אך היא נשענת על שירותים חיצוניים (אתרי תוצאות, רשתות חברתיות, ספקי ענן) ואיננו מתחייבים לזמינות מלאה. השירות ניתן כמות שהוא. אחריות RAKIA כלפי המועדון מוגבלת לסכום ששולם ב-12 החודשים שקדמו לאירוע. ההגבלה אינה חלה על נזק שנגרם בכוונה או ברשלנות רבתי, על פגיעה בפרטיות או באבטחת מידע שנגרמה על ידי RAKIA, ועל נזק גוף. אין באמור כדי לגרוע מזכויות שאינן ניתנות להתניה לפי דין.

סיום

כל צד רשאי לסיים את ההתקשרות בהודעה בכתב של 30 יום. עם הסיום, המועדון יכול לבקש עותק של הפוסטרים שלו, ונתוני המועדון יימחקו כמפורט במדיניות הפרטיות. אלא אם נקבע אחרת בהסכם בכתב, לא ייגבו תשלומים עבור התקופה שאחרי מועד הסיום, וסכום ששולם מראש עבורה יוחזר באופן יחסי.

דין וסמכות שיפוט

על תנאים אלה חל הדין הישראלי. סמכות השיפוט נתונה לבתי המשפט המוסמכים בישראל, לפי כללי הסמכות המקומית שבדין. תנאים אלה נכתבו בעברית ובאנגלית. אם יש סתירה ביניהם, הנוסח העברי קובע, ומול לקוח מחוץ לישראל הנוסח האנגלי קובע. אם אתם משתמשים ב-RAKIA כצרכנים (למשל בדלת האישית), אין בכך כדי לשלול מכם את ההגנות של דיני הגנת הצרכן המחייבים במדינה שבה אתם גרים, ואתם רשאים להגיש תביעה גם בבתי המשפט שם.

שינויים

נעדכן עמוד זה כשמשהו משתנה, עם תאריך העדכון למעלה. על שינוי מהותי נודיע ללקוחות במייל לפחות 30 יום לפני שייכנס לתוקף. מועדון שאינו מסכים לשינוי רשאי לסיים את ההתקשרות לפני מועד השינוי, בלי לחכות לתקופת ההודעה של 30 יום, והשינוי לא יחול עליו. מחיר ותנאי תשלום משתנים רק לפי ההסכם בכתב עם המועדון.

Who runs the service

RAKIA by KesemItay. The service is operated by Itay Mizrachi, a registered sole proprietor (Osek Patur) in Israel. Address: 11 Shivat Zion St., Rishon LeZion, Israel. Contact: kesemitaymedia@gmail.com. The agreement with a club is made when a club representative signs up and accepts these terms, or by a signed agreement. These terms apply together with the Privacy Policy and the Data Processing Agreement.

What the service is

RAKIA detects club athletes' achievements from published competition results, produces posters and social-media content in the club's design, and lets the club approve and publish. Nothing is published without a club representative's approval.

Artificial intelligence

Posters and captions are produced with third-party AI models (listed in the privacy policy), from real photos the club supplies. The system may change the background, lighting and clothing (for example dressing the athlete in the club kit). It is built to keep the athlete's real face and checks it, but output can contain mistakes, so the club checks every poster before approving it and is responsible for publishing what it approves. Do not use the system to create a misleading, degrading or sexual image of a real person, or political or election content. A person shown on a poster who wants it removed can write to kesemitaymedia@gmail.com. Within 48 hours we remove it from RAKIA and ask the club to remove any copies it already published. Roki, the chat that helps create and change posters, is an automated AI assistant, not a person, and can make mistakes; check the plan and the poster before you approve, download or publish it. A poster painted with AI may carry an invisible mark in its file saying it was made with AI (not one pixel changes). If a poster shows a real person in a place or moment that did not really happen, the law where you publish it (for example the EU AI Act) may require you to say it was made with AI; Instagram and Facebook offer an AI label for this.

Club account

  • The service is offered to organisations (clubs, associations, federations and companies) for their activity; whoever signs up confirms they act for such an organisation. The club opens its account on the site, or RAKIA opens it for the club. The club is responsible for whom it invites and for keeping sign-in details safe.
  • The club agrees to provide accurate information and keep it current.

Photos, rights and consent: the club's responsibility

  • The club confirms it has the right to use every photo, logo and asset it uploads or connects, including photographer credit where required. That right includes permission to adapt and change the photo into a poster, including with AI. If it does not, the club is responsible for any resulting claims.
  • The club is responsible for obtaining informed consent from athletes, and from a parent or guardian for athletes under 18, before adding them or their photos to the system, including for face matching, AI processing and publication. By adding an athlete or a photo, or connecting a photo folder, the club confirms it has that consent.
  • Consent through the club. By joining a club that uses RAKIA, an athlete (or a parent or guardian, for an athlete under 18) agrees, through the club, that their photos are used and their face is matched to make the club's posters. The club is responsible for getting and keeping that consent (it confirms it each time it adds an athlete) and for telling its athletes. RAKIA has no separate switch for each athlete: an athlete who no longer wants this asks the club, and the club removes the athlete's photos (or asks us to); the photos and the face-matching results are then deleted.
  • RAKIA shows a poster produced for a club as an example of its work only after the club agrees in writing and the athletes shown in it (a parent or guardian for anyone under 18) have agreed to this use by RAKIA. The club or the athlete may withdraw that agreement at any time, and RAKIA then removes the poster from its site and materials within 14 days.
  • Data protection. For athletes' personal data the club is the controller and RAKIA the processor. Our Data Processing Agreement at /dpa forms part of these terms and applies from the first upload.

The personal door (beta)

At app.rakia.io/personal_beta a private person can order posters for themselves. The personal door is for people aged 13 and over; from 13 to 17 a poster is painted only after a parent says yes (see the Privacy Policy). This is a beta: it is free, limited to a number of paints per person (5 to start; a new poster, a change that repaints the whole poster or a story costs one paint, a small fix to the picture may cost half a paint, and word and logo edits done by code are not counted), and provided as is, with no promise of availability or of a result. By uploading a photo you confirm you have the right to use it and the photos of the people in it and, if a minor appears in it, that a parent agreed. The posters are for your personal use. There is no payment in the beta; if payment opens in the future, the price and the cancellation terms will be shown before any charge.

What you upload, the example, and takedown

  • You are responsible for what you upload. Upload only photos, examples and logos you own or have permission to use, and only photos of other people who agreed.
  • The example poster you add is used for its style only: colours, layout and feel. RAKIA never copies its people, photos or words.
  • Notice and takedown. If you believe something made on RAKIA infringes your rights, write to kesemitaymedia@gmail.com (or use the infringement report form), and we review and remove it within 48 hours. We keep a record of every notice.
  • Point of contact (under the EU Digital Services Act, for authorities and users): kesemitaymedia@gmail.com, in Hebrew or English. Every notice is reviewed by a person on our team, not only by a machine.

Intellectual property

RAKIA assigns to the club whatever rights it holds in posters produced for it and grants the club a free licence to use them. This does not override the rights of the athletes shown or of the photographers. The system, the engine, the generic designs and the RAKIA brand belong to KesemItay. Do not copy, reverse-engineer or resell the system.

Fair use

Do not use the system to produce content that is offensive, misleading or infringes others' rights. RAKIA may suspend an account that breaks these terms after written notice and 7 days to fix the breach. Unlawful content, or content that harms a minor, is removed at once, and we tell the club.

Payment

Price, payment terms and contract period are set in a separate written agreement with each club. Until an agreement is signed, the service is provided as a pilot. A pilot never turns into a paid service by itself; paid service starts only with a signed agreement.

Availability and liability

We work to keep the system running continuously, but it depends on external services (results websites, social networks, cloud providers) and we do not guarantee full availability. The service is provided as is. RAKIA's liability to the club is limited to the amount paid in the 12 months before the event. This limit does not apply to damage caused intentionally or by gross negligence, to a privacy or data-security breach caused by RAKIA, or to bodily harm. Nothing here limits rights that cannot be waived by law.

Termination

Either side may end the relationship with 30 days' written notice. On termination the club may request a copy of its posters, and club data is deleted as described in the privacy policy. Unless the written agreement says otherwise, no fees are charged for any period after the end date, and any amount prepaid for that period is refunded pro rata.

Governing law

These terms are governed by the laws of Israel. The competent courts in Israel have jurisdiction, according to the venue rules set by law. These terms are written in Hebrew and English. If they conflict, the Hebrew text prevails, except for a customer outside Israel, for whom the English text prevails. If you use RAKIA as a consumer (for example at the personal door), this does not take away the protection of the mandatory consumer law of the country where you live, and you may also bring a claim in the courts there.

Changes

We update this page when something changes, with the date at the top. We email customers about a material change at least 30 days before it takes effect. A club that does not agree may end the relationship before the change takes effect, without waiting for the 30-day notice period, and the change will not apply to it. Price and payment terms change only as set out in the written agreement with the club.
